Good News on the Equal and Uniform Front for Texas Property Taxation!

The Texas Supreme Court recently denied Travis CAD’s request for mandamus relief to reverse the trial court’s denial of its motion to compel production of the taxpayer’s financials in an equal and uniform case. See https://www.txcourts.gov/supreme/orders-opinions/2025/december/december-5-2025/.

This appears to be the first instance of addressing discoverability of financial information in equal and uniform cases since last year’s Texas Supreme Court opinion in another TDSL case in which the Court indicated that market value may be relevant in some equal and uniform cases.  

Since that opinion in 2024, appraisal districts have consistently argued that financials are automatically discoverable in equal and uniform.  But not so fast, as both the trial court and the Third Court of Appeals, after receiving briefing, rejected TCAD’s claims that the taxpayer’s financial information was discoverable See https://search.txcourts.gov/Case.aspx?cn=03-25-00441-CV&coa=coa03. Today, the Texas Supreme Court did not see a reason to reverse those rulings.
